Acceptable Use Policy

1. Prohibited Activities
You agree not to use the Voxifi Service (“Service”) for any of the following:
- Any activity that violates applicable local, state, national, or international law or regulation
- Harassment, threats, intimidation, or abuse of any person
- Fraud, identity theft, phishing, or deceptive practices
- Distributing malware, viruses, or other harmful code
- Attempting to disrupt, overload, or interfere with the Service or its infrastructure
- Unauthorized access to other users’ accounts, systems, or data
- Scraping, data mining, or automated collection of data from the Service without authorization
- Reselling or redistributing the Service without written permission from Voxifi
- Generating, distributing, or facilitating spam or unsolicited communications
- Creating voice agents that impersonate law enforcement, government officials, or emergency services
- Any activity that infringes on the intellectual property rights of others
2. Telemarketing Compliance
If you use the Service for telemarketing or outbound calling campaigns, you are solely responsible for compliance with all applicable telemarketing laws and regulations, including but not limited to:
2.1 Federal Regulations
- Telephone Consumer Protection Act (TCPA) — Obtain prior express written consent before making automated or prerecorded calls to consumers. Maintain records of consent.
- FTC Telemarketing Sales Rule (TSR) — Comply with all TSR requirements, including prompt identification of the caller and purpose of the call.
- Do Not Call (DNC) Registry — Scrub your call lists against the National Do Not Call Registry before each campaign. Maintain an internal DNC list and honor opt-out requests within 30 days.
- FCC Rules — Comply with all FCC regulations regarding autodialed calls, prerecorded messages, and caller ID transmission.
2.2 State Regulations
Many states have additional telemarketing regulations that may be more restrictive than federal law. You are responsible for understanding and complying with the laws of each state where you conduct calling operations, including state-specific DNC lists, calling hour restrictions, and registration requirements.
2.3 Consent Documentation
You must maintain adequate records of consent for all telemarketing activities, including:
- The date, time, and method of consent collection
- The specific language used to obtain consent
- The identity of the person who consented
- The phone number(s) for which consent was obtained
2.4 DNC List Scrubbing
You must scrub your call lists against the National DNC Registry at least every 31 days. You must also maintain an internal DNC list and process opt-out requests promptly.
3. AI Voice Disclosure
You must disclose that a call is being conducted by an AI agent at the beginning of every call. This disclosure must be clear, conspicuous, and made before any substantive conversation occurs. Failure to disclose the AI nature of the interaction may violate federal and state consumer protection laws.
Recommended disclosure language: “This call is being made by an AI voice assistant on behalf of [Your Company Name].”
4. Voice and Likeness Rights
You may not use the Service to:
- Clone, replicate, or simulate a real person’s voice without their explicit written consent
- Create voice agents that impersonate specific individuals
- Use a person’s voice, likeness, or identity in a way that is misleading or defamatory
- Generate deepfakes or synthetic media intended to deceive
You are responsible for obtaining all necessary rights and permissions for any voice recordings or voice models you use with the Service.
5. Fraud Prevention
You may not use the Service to:
- Conduct or facilitate any type of fraud, including financial fraud, identity fraud, or wire fraud
- Trick or manipulate individuals into providing personal information, financial details, or access credentials
- Spoof caller ID information to misrepresent the origin of calls
- Conduct social engineering attacks
- Impersonate banks, government agencies, or other trusted entities
6. High-Risk Use Disclaimer
The Service is not designed or intended for use in high-risk environments where failure could lead to death, personal injury, or significant property damage, including but not limited to:
- Medical diagnosis, treatment, or emergency services (e.g., 911 dispatch)
- Air traffic control or aviation operations
- Nuclear facility operation or control
- Autonomous vehicle control systems
- Life-critical infrastructure management
You agree not to use the Service for any high-risk purpose. Voxifi disclaims all liability for damages arising from such use.
7. HIPAA Disclaimer
The Service is not HIPAA-compliant by default. Voxifi does not act as a Business Associate and does not enter into Business Associate Agreements (BAAs) unless separately agreed upon in writing.
You must not transmit, process, or store Protected Health Information (PHI) through the Service unless you have entered into a separate BAA with Voxifi. If you require HIPAA compliance, please contact us at support@voxifi.io to discuss options.
8. Consequences of Violation
Violation of this Acceptable Use Policy may result in:
- Warning — For minor or first-time violations, we may issue a warning and require corrective action.
- Suspension — We may immediately suspend your access to the Service pending investigation.
- Termination — We may permanently terminate your account without refund.
- Legal Action — We may pursue legal remedies, including reporting violations to law enforcement.
We reserve the right to determine, in our sole discretion, whether a violation has occurred. We are not obligated to provide notice before taking action, though we will make reasonable efforts to do so when circumstances permit.
